Nevada Court Halts Flawed Proposed Ballot Initiative Aimed At Interfering With Women’s Private Health Care Decisions

CARSON CITY, NV – In a legal challenge seeking to block the “Personhood Nevada” petition, an initiative that could potentially ban a range of reproductive health care in the state, Judge Russell of the First Judicial District today declared the initiative invalid. 

An individual woman, a pharmacist and an obstetrician-gynecologist filed a legal challenge against the petition on November 12, 2009, arguing that the initiative proposes far reaching changes to the Nevada Constitution and laws, is misleading and fails to give voters a clear understanding of the changes it proposes and its purpose and effect.

“I am pleased that the court recognized that the initiative was confusing and failed to tell voters that it would affect access to reproductive health services,” said Emmily Bristol, one of the plaintiffs.

The initiative attempted to re-define the term “person” to include a fertilized egg and all subsequent stages of prenatal development.  According to the initiative’s proponents, the newly defined “persons” would have full constitutional rights under the Nevada Constitution.  The initiative could have banned all abortions and commonly used forms of birth control.  In addition, it could have interfered with doctors’ ability to treat life-threatening pregnancies, miscarriages, and infertility, as well as banned some stem cell research and other life-saving therapies and cures.

“Today’s decision rightfully prevents this sweeping and misleading initiative from being placed on the 2010 ballot,” said Lee Rowland, one of the attorneys for plaintiffs.  “This initiative could have impacted literally thousands of laws, inviting lawyers and the courts to reinterpret every Nevada law and regulation that contains the word ‘person’ all at the expense of Nevada taxpayers.  The key problem is that it covered too many issues, and failed to explain to voters its intent and impact on Nevada law.”

Plaintiffs in today’s legal challenge, Bristol v. Personhood Nevada, include Emmily Bristol, Dr. Mindy Hsu, and Dr. William Ramos. Severin A. Carlson Elected as Chair of
Nevada Certified Court Reporters Board – 2010

CARSON CITY:  In 2007, Governor Jim Gibbons appointed Severin (“Sev”) A. Carlson, an attorney with Kaempfer Crowell Renshaw Gronauer & Fiorentino (Kaempfer Crowell), to the Nevada Certified Court Reporters Board (“Board”), which regulates and controls the practice of court reporting. The five member Board is comprised of three court reporters, one public member and one attorney. Last week, the members elected Sev to serve as Chair of the Board in 2010.

A native Nevadan, Sev works in Kaempfer Crowell’s Northern Nevada office where he handles administrative law, water law, and commercial litigation matters. He is an active member of the State Bar of Nevada, a requirement that a practicing attorney must meet to serve on the five-person Board. The Board reports to the Governor and was established by the Nevada Legislature to oversee the practice of court reporting since the profession affects the public health, safety and welfare of Nevadans.

LAS VEGAS – The Nevada law firm of Kummer Kaempfer today announced the addition of two new attorneys to its firm, both formerly of Bullivant Houser Bailey.  Peter Bernhard, Chairman of the Nevada Gaming Commission, and Georganne Bradley will further bolster the firm’s already extensive lineup of experience in litigation and transactional services.

Peter Bernhard was named Chairman of the Nevada Gaming Commission in 2001 and previously served as a member and chair of the Nevada Commission on Ethics.  During his tenure on the Gaming Commission, Bernhard presided over the two largest combinations in Nevada history – MGM- Mandalay and Harrahs – Park Place Entertainment, along with numerous licensing proceedings and for transfers of existing properties throughout the state of Nevada.  Bernhard currently represents Keep Memory Alive and the Cleveland Clinic Lou Ruvo Brain Institute, both non-profit entities dedicated to the study of neurodegenerative brain disorders such as Alzheimers, ALS and Parkinsons Disease.  In addition to his extensive experience in litigation and transactions, he lectures regularly in continuing education and training programs for the State Bar of Nevada, the University of Nevada Las Vegas and the Executive Development Program at the University of Nevada Reno.

LAS VEGAS – The statewide law firm of Kummer Kaempfer Bonner Renshaw & Ferrario (Kummer Kaempfer) is realigning its practice areas and introducing a new organizational structure that will support the firm’s continuing market dominance in government and legislative affairs, energy and utilities and the litigation and transactional practice areas.

These changes coincide with several of the firm’s partners, of counsel attorneys, associate attorneys and staff members departing on June 1 to join the international law firm of Greenberg Traurig.  This repositioning follows many months of careful thought and deliberations about a possible merger between the two law firms.  

“The firm will continue its longstanding tradition of serving our clients with the highest levels of excellence,” said Bob Gronauer, who will remain managing partner and a senior member of the land use and governmental affairs team of Kummer Kaempfer.  “During the transition, our clients we serve can rest assured that our collective commitment to seamless service and client delivery stands above all else.”

“This is a difficult, but cordial decision that reflects the desires of certain practice groups in our firm to practice in an international firm,” said Michael Bonner, who will be joining Greenberg Traurig and currently serves as Kummer Kaempfer’s Chairman of the Executive Committee. “We will continue to work together with our Kummer Kaempfer colleagues as co-counsel on many matters now and in the future. More importantly, we will remain good friends.”

Kummer Kaempfer Names Robert Gronauer Managing Partner; Elects Four Attorneys to its Board of Directors

Kummer Kaempfer Names Robert Gronauer Managing Partner; John Griffin, Brandon Roos, Steve Tackes and Jason Woodbury Elected to the Firm’s Board of Directors

 LAS VEGAS – The statewide law firm of Kummer Kaempfer Bonner Renshaw & Ferrario (Kummer Kaempfer) has elected four attorneys to become members of the firm’s Board of Directors, commonly referred to in the profession as “partners” and also named a new managing partner effective April 1, 2009. 

 Michael J. Bonner, the firm’s managing partner, announced that John W. Griffin, Brandon E. Roos, Steve E. Tackes and Jason D. Woodbury have been elected as new directors.  He also announced that longtime partner Robert J. Gronauer will assume the position of managing partner and president of the law firm.  Gronauer replaces Bonner, who will become chairman of the firm’s executive committee.  The firm currently has 18 other directors.

 Gronauer joined Kummer Kaempfer in 1996. Roos has been an associate in the Litigation Department focusing his practice on civil, commercial and general business litigation. He joined the firm in 2005. He has successfully resolved numerous business disputes and obtained judgments for clients in complex civil litigation involving fraud, breach of contract and negligence. Roos was co-lead counsel on behalf of numerous plaintiffs defrauded in the collapse of Southwest Exchange, Inc., a case in which he helped recover in excess of $91 million on behalf of the victims.  Roos also has experience in intellectual property law, primarily on obtaining trademark and service mark protection for his clients.  Roos has been named a Rising Star by Mountain States Super Lawyers.  He is a member of the Board of Directors for Boys Hope Girls Hope, a charitable organization in Southern Nevada.  Roos is based in Las Vegas.

Tackes has been Of Counsel to the firm and practices in the areas of business law, technology, aviation, and administrative agency law. Erin Russell Hayes received the Las Vegas Business Press’ Rising Stars of Business Award, a prestigious recognition presented annually to 10 individuals for their outstanding business accomplishments.  City of Las Vegas Mayor Oscar Goodman presented the awards at a March 20 luncheon at the Hard Rock Café.  Russell Hayes, a government affairs advocate, has been with Kummer Kaempfer since December 2005.

Kummer Kaempfer Named a Finalist in the “Greater Reno-Tahoe Best Places to Work” Awards

The finalists were chosen from nearly 120 companies that were nominated based on employee satisfaction surveys and meeting the award program requirements.  Winners will be announced at an awards reception on Thursday, April 30, 2009 at the Atlantis Casino Resort Spa.

Finalist and winning companies fall into three categories based on their number of employees including small, medium and large categories.  One winning company will be chosen from each category based on scores from confidential employee surveys that are objectively analyzed by Quantum Workplace, the exclusive research partner for Best Places to Work Awards nationwide. Surveys focus on ten criteria including: team effectiveness, trust with coworkers, individual contributions, manager effectiveness, feeling valued and people practices, among others. Awards for 2nd and 3rd place in each category will also be presented. EDAWN, the Reno Gazette-Journal and the Northern Nevada Human Resources Association co-sponsor the program and awards.
